THANKS TO YOU Prop 202, the "Employer Amnesty" Initiative, lost by 18.9%.  Below is the breakout table by counties and I am very proud to say that because of your efforts WE won in EVERY COUNTY!

There are a lot of people and organizations who pooled their resources, money and time to help Arizona win this fight.  From the individual citizens who took the time to write editorials in their home town paper against Prop 202, who advised their neighbors and friends on how to vote against Prop 202, who kept us apprised of the opposition's fraudulent advertisments, the national organizations who donated money and used their vast E-mail network to help educate the people of Arizona about the fraud of Prop 202.

Legal Arizona Workers Act Amended to Clarify Enforcement, Sanctions and Defenses

Just a few months after the Legal Arizona Workers Act (the “Act”) took effect at the beginning of the year, the Arizona legislature has enacted HB 2745 to amend the law that requires employers to use the federal employment eligibility verification system, E-Verify, and imposes sanctions on employers that hire unauthorized workers. Governor Janet Napolitano signed HB 2745 into law on May 1, 2008, and the amendments became effective immediately.

..... Proposition 202 is dubbed the Stop Illegal Hiring Act. But this isn't the get-tough law it purports to be. If it passes, the most strident opponents of illegal immigration will have a cause and very likely push a truly punitive measure for the 2010 ballot.

Arizona has nothing to gain from continuing a bitter battle over how far the state can go in regulating illegal immigration on its own. Business has learned to live with the current law. We should let it rest for now.

HISTORY

Arizona has the most effective, non-discriminatory employer sanctions law in the nation.  It has been upheld in four court challenges. The Legal Arizona Workers Act, which went into effect Jan. 1, 2008, requires all Arizona employers to use the E-Verify program. E-Verify is an essential tool to assure a legal workforce.   It achieves an accuracy rate of 97 percent by matching names, birth dates, social security numbers and, in some instances, photos for job seekers.

As early as October of 2007, before the new law went into effect, Arizona saw positive results. Illegal workers were leaving voluntarily.  Fraudulent documents and identity theft that were previously used were no longer enough to obtain employment.

The Stop Illegal Hiring Act (Prop 202) was drafted for a consortium of businesses, chambers of commerce, and trade associations seeking an endless supply of cheap illegal labor.  Those organizations would profit from a modern-day form of slavery − exploiting illegal aliens.   Those same groups were responsible for legal efforts which were rejected by District Court and the Ninth Circuit Court.

The "illegal" employers and the Az Chamber are running the Stop Illegal Hiring ballot measure which has several troubling parts.  Their ballot measure references current existing laws such as HB2779  to make it sound tough, however the real purpose of the Stop Illegal Hiring ballot measure is to creat loopholes to limit complaints, exempt certain licenses from suspension or revocation and give employers Amnesty from any prosecution if they use the Basic Pilot even if they get caught cheating.

 

1)      Specifically eliminated the use the Federal definition of an unauthorized alien as found in 8 United States Code 1324a(h)(3).

 

2)      It limits complaints that can be filed, only by affidavit and in writing disallowing the Silent Witness Program in only these types of complaints and allows citizens to be charged with a crime if they feel the complaint is frivolous.  Very dangerous and threatening to the public who act in good faith only to find out the information did not pan out. (page 3: 22-212.B)    

 

3) It gives Employers a NON-rebuttable presumption of innocence if they use the Basic Pilot Verification Program.  Which is Employer Amnesty, you cannot challenge the info, if they use this program even if they are found to have knowingly hired an illegal as long as they use the program.  This is absolutely outrageous. (page 7: 23-212.I)

 

4) 23-215 PUNISHMENT OF CASH-PAYING, TAX AVOIDING ILLEGAL EMPLOYERS (pg 7 & 8) If an employer pays hourly wages in cash to 4 or more employees and fails to withhold and report the required state and federal payroll taxes the employer is subject to specific penalties including fines.  Accumulated fines will be directed to the Department of Health Services and the Department of Education by the Attorney General.

“The federal government first created sanctions for employers of unauthorized aliens in the Immigration Reform and Control Act of 1986 ("IRCA"), Pub. L. No. 99-603, 1 00 Stat. 3359 (employer sanctions provisions codified at 8 U.S.C. 5 1324a to 1 324c (2000)). States at that time had authority to enact and enforce sanctions against employers of unauthorized aliens.”

 

 “IRCA expanded those state efforts to the national level. Congress also declared that IRCA "preempt[s] any State or local law imposing civil or criminal sanctions (other than through licensing or similar laws) upon those who employ, or recruit or refer for a fee for employment, unauthorized aliens." 8 U.S.C. 1324a(h)(2).”

 

 “Congress realized that the 1-9 system was imperfect. In IRCA's text, it authorized valuation and change of the employment verification system:"

 

 "Because E-Verify remains voluntary at the national level, the 1-9 process is still the main employment verification process used by employers. However, the 1-9 system has been thoroughly defeated by document and identity fraud, allowing upwards of eleven million unauthorized workers to gain employment in the United States labor force, with the number increasing at about a half a million a year. "

 

 "The President shall provide for the monitoring and evaluation of the degree to which the employment verification system . . .provides a secure system to determine employment eligibility in the United States and shall examine the suitability of existing Federal and State identification systems for use for this purpose.”

 

 “To the extent that the system established under subsection (b) is found not to be a secure system to determine employment eligibility in the United States, the President shall. . . implement such changes. . , as may be necessary to establish a secure system to determine employment eligibility in the United States.”

Our Endorsement: No on changes to employer-sanctions law

When the legislature pass an employer sanctions bill that was signed into law last year, it was considered legally questionalble.

But the law has functioned largely as intended.  So Proposition 202, which is pushed as a "fix", is uneeded and may undermine the current law.

Arizona's current employer sanctions law has been working extremely well at reducing illegal immigration in Arizona.  The Stop Illegal Hiring ballot measure stands in stark contrast in both form and substance to our current law that was passed by the legislature and signed by the Governor. 

In spite of this ballot measure’s title, its intent is to support actions by both employers and illegal immigrants so they can continue to flaunt federal and state laws. Unbelievably, it replaces federal definitions and consequences of being an illegal alien and hiring an illegal alien with language that supports illegal alien and employer amnesty.
